The problem
NOM-035 has been in force since 2019 and NOM-037 since 2023. Knowing they exist is not the same as complying with them.
NOM-035 is Mexico’s mandatory standard on psychosocial risk at work, and NOM-037 regulates remote work. Most companies know about the obligation, but they haven’t applied the assessment, documented the policy or delivered the training. An inspection by the STPS, Mexico’s Ministry of Labor, can end in fines for non-compliance.

Frequently asked questions
How many employees does it take for NOM-035 to apply?
It applies to every workplace, but the obligations grow with size: up to 15 employees they're basic; from 16 to 50 they include the psychosocial risk factor questionnaire; and from 51 on, an assessment of the organizational environment is added.
What about NOM-037 on remote work?
It applies to any company with people who work remotely more than 40% of their time, regardless of headcount.
